DePuy Orthopaedics, Inc. is currently facing nearly 6,400 hip implant lawsuits in ongoing multidistrict litigation (MDL) proceeding in the U.S. District Court for the Northern District of Texas. In fact, according to the court docket, as of June 30th, 6,382 hip implant lawsuits were pending against DePuy based on claims that the:
- DePuy Pinnacle hip implant device was defective.
- DePuy was negligent in its responsibility to test the safety of its hip implant devices.
- DePuy knew about the significant risks of serious health complications associated with the use of the Pinnacle hip implant. Among these risks were the dangers of the device failing, the modular neck breaking, patients developing metallosis (metal poisoning) and patients sustaining various other hip implant injuries and complications.
The snowballing number of cases, which are being overseen by the Honorable Judge Ed Kinkeade, are underway In Re: DePuy Orthopaedics, Inc., Pinnacle Hip Implant Products Liability Litigation 3:11-md-02244.
DePuy Hip Implant Lawsuits: A Settlement May Come Before Trial
As the thousands of DePuy hip implant lawsuits continue to proceed in the MDL, more cases may be filed on behalf of other injured patients throughout the U.S. What this may ultimately end up doing is intensifying the pressure on DePuy, compelling the hip implant manufacturer to offer plaintiffs a settlement to try to avoid trial in these cases.
Such settlements (if they end up being adequate and fair) should cover the costs of:
- Patients’ prior medical bills
- Their ongoing treatment
- Their potentially lost wages
- Their mental anguish
- Any possible impacts to their quality of life.
It remains to be seen whether DePuy will make a settlement offer to try to resolve some of the hip implant lawsuits it’s facing prior to trial or whether the medical device manufacturer will insist on fighting injured plaintiffs through trial.
