About four years after issuing the DePuy ASR hip implant recall and approximately 9 months after reaching a settlement with thousands of injured people involved in DePuy hip implant lawsuits, Johnson & Johnson’s (J&J) DePuy has finally starting paying out some of the hip implant lawsuit settlements promised back in November 2013.
According to recent reports and updates regarding these hip implant lawsuit settlements:
- The only plaintiffs included in this settlement were injured people who had to undergo at least one revision surgery prior to August 13, 2013 due to their hip implant complications and injuries.
- Most of these settlement payments will be made this month.
- The base payment for the agreed-upon hip implant lawsuit settlements is $250,000.
- People with exceptional or extraordinary injuries may apply for additional compensation. If approved, the additional settlement award will be granted at some point this fall.
More Hip Implant Lawsuit Settlements Will Likely Come – But Are They Enough?
To date, experts estimate that more than $250 million in hip implant lawsuit settlements have been paid out to injured people. However, with tens of thousands of hip implant lawsuits still pending in federal courts throughout the U.S., many expect that it will not be long before DePuy (and other hip implant manufacturers) put another hip implant settlement on the table in an effort to try to avoid costly litigation.
While this may seem like good news to some, it’s important that injured plaintiffs and their families realize that hip implant lawsuit settlements like the ones currently being paid out by DePuy may NOT be sufficient to compensate people for their long-term injuries and medical needs, as well as any irreversible impacts they have suffered to their quality of life.
Consequently, if you’re an injured hip implant patient and/or are currently involved in ongoing litigation against DePuy (or another manufacturer), make sure you speak to an attorney before accepting any hip implant lawsuit settlements.
